FAQ

Common Questions

How long does trademark registration take in India? +
The full process typically takes 18–24 months from filing to registration. However, your trademark is protected from the date of filing, not the date of registration. With expedited examination, the process can be faster. IPMitra tracks every stage and alerts you at each milestone.
What is the government fee for trademark registration? +
The government fee is ₹4,500 per class for individuals, startups, and MSMEs filing online. For companies (Private Limited, LLP, etc.), it is ₹9,000 per class. This fee is paid directly to IP India — IPMitra charges a separate professional fee for our services.
What is a Nice Classification class? +
The Nice Classification system organizes goods and services into 45 classes. Every trademark is registered in one or more of these classes. For example, Class 32 covers beverages, Class 25 covers clothing, and Class 41 covers education. Choosing the wrong class is one of the most common filing mistakes — our experts suggest the right class based on your business description.
What happens if my trademark gets an objection? +
The examiner may raise objections under Section 9 (absolute grounds — descriptive, generic marks) or Section 11 (relative grounds — similar to an existing mark). You have a deadline to respond, typically 30 days. IPMitra lawyers draft a professional reply addressing each objection. Failure to reply results in abandonment of your application.
Can I track my application status on IPMitra? +
Yes. Standard and Premium plan clients get access to the IPMitra dashboard where you can see the live status of your application, all documents filed, upcoming deadlines, and receive automatic WhatsApp and email alerts when your status changes.
Do I need a lawyer to register a trademark? +
Technically you can file yourself, but it's strongly not recommended. Incorrect class selection, poorly drafted applications, or missed objection deadlines are expensive mistakes. Having a lawyer review and file your application significantly improves your chances of successful registration — and that's exactly what IPMitra provides at an affordable fee.
